These Terms of Service ("Terms") govern all services provided by WebNest Creations ("WNC," "we," "our," or "us") to any customer ("Client," "you," or "your"). By engaging WNC for any website, digital service, subscription, or deliverable, you agree to be bound by these Terms.
If you do not agree with these Terms, do not use our services.
WebNest Creations provides a range of digital and AI-enhanced services, including but not limited to website design, AI-powered builds, migrations, digital presence setup, hosting, maintenance, support, content creation, and change requests.
WNC may update or modify services at any time.
All website packages require a non-refundable setup deposit. No work begins until the deposit is paid. This covers initial design, AI setup, project configuration, and onboarding.
An active subscription is required to keep the website online. Subscription fees cover hosting, backups, security, platform access, and care plan features.
Failed payments not resolved within 3 days may result in the website being marked "temporarily disabled" or "suspended."
Deposits, setup fees, completed work, and monthly subscription payments are fully non-refundable.
Typical delivery timeframes:
Timelines depend on Client responsiveness and project complexity.
Each package includes limited revisions. Additional revisions or scope changes are treated as paid change requests.
A project is considered complete when:
Once complete, the subscription activates and additional work follows care plan or change request rules.
Client agrees to provide accurate information, respond promptly, submit legally owned content, supply needed credentials, and ensure all provided materials comply with applicable laws.
WNC is not responsible for delays or errors caused by incomplete or incorrect Client information.
WNC retains ownership of website structure, templates, design systems, layouts, AI prompts, automations, internal tools, and AI-generated content unless explicitly transferred.
Client receives usage rights only while subscription remains active.
Client retains ownership of content they provide (logos, text, images).
If subscription ends:
Domain registration and renewal are the Client's responsibility unless WNC is explicitly contracted to manage them.
WNC is not responsible for a domain lost due to non-payment or expiration.
Features vary by tier but may include hosting, backups, security, updates, improvements, and support.
Downtime caused by third-party platforms is outside WNC control.
Anything outside the original scope (extra pages, structural changes, redesigns, content changes, new features) is billed as a change request.
Quotes are provided before work begins.
Client may cancel anytime. Cancellation takes effect at the end of current billing cycle.
WNC may suspend or terminate services for payment failure, violation of Terms, abusive or unlawful behavior, security risks, or platform requirements.
WNC is not liable for losses resulting from suspension.
Services are provided "as-is" and "as-available."
WNC makes no guarantees regarding SEO performance, financial results, uptime, accuracy of AI-generated content, or compatibility across all devices.
Client must review and confirm accuracy before launch.
WNC is not liable for:
Maximum liability is limited to fees paid in the previous 60 days.
Client agrees to indemnify and hold WNC harmless from claims arising from Client content, misuse, legal violations, or breach of these Terms.
Client acknowledges that WNC uses AI for content, visuals, structure, SEO suggestions, and automations.
AI may generate errors or imperfect content.
Client must review final content before publishing.
WNC is not liable for inaccuracies produced by AI tools.
Both parties agree to confidentiality regarding non-public project information.
WNC may display anonymized previews or portfolio examples unless requested otherwise in writing.
These Terms are governed by the laws of the State of Georgia, USA.
Disputes must be handled in Georgia courts.
WNC may update these Terms at any time. Continued use of services indicates acceptance of updated Terms.
